read moreMarrickville Council in inner Sydney is suing Adco Constructions for more than $5 million of defects at the $18 million Annette Kellerman Aquatic Centre.
The Centre, which opened in December 2010, includes a 50 metre pool, learn-to-swim pool and leisure pool, seating, changing facilities, office and reception area, toilets and lockers, cafe, and fitness and gym facilities.
In a December 2013 report, the council’s Major Projects Executive Manager, William Blunt, said Adco had failed to rectify defects, complete some works and finish required commissioning processes.
The report stated “prior to and since council began operations at the centre on December 11, 2010, there has been a growing list of identified defective and incomplete works that together with a significant dispute regarding practical completion, commissioning of services and the recovery of moneys already paid to Adco, has resulted in council taking action against Adco.
“The action seeks repayment of moneys and damages in excess of $5 million.’’
Identifying 1816 defects or items of incomplete works, the report added that the Council had to rectify the defects, complete some works and finish commissioning works, while operating the centre and managing community expectations.
In reply to the proceedings, the company admitted 50 of 1592 defects and denied liability for the remainder.
The proceedings are ongoing and are scheduled to be heard in the Supreme Court of NSW in February.
