As of 12th November, small business entering into contracts where there is little or no ability to negotiate the terms will be protected by law from unfair terms after 12th November.
As a result, the ACCC advise that “if you are about to enter into or sign a new contract, consider whether you can wait until after this date to gain this protection.”
In addition, small businesses that supply standard form contracts now only have a limted amount of time to amend or remove any potentially unfair contract terms before the new laws come into force.
After 12th November, the ACCC will be able to take enforcement action against businesses who offer small business standard form contracts that contain unfair contract terms
Click here to view information about the new law on the ACCC website.
The ACCC will also be issuing a small business unfair contract terms industry review report which will be available on the ACCC website as of 10th November 2016.
