‘Insufficient evidence’ to prosecute Falls Festival organiser over crowd crush
A WorkSafe Victoria investigation has found that there is "insufficient evidence to prosecute" the organisers of the December 2016 Falls Festival that saw a crowd crush in which more than 70 people were injured.
19 people were taken to hospital after a crush involving festival goers moving between stages at the annual Festival on the evening of Friday 30th December 2016.
They were crushed against barriers and crowd footage showed a domino effect as fans fell on top of each other.
Following the incident, upcoming performances within that venue were suspended with Emergency Services and WorkSafe Victoria conducting investigations into the cause of the incident.
A WorkSafe Victoria statement has advised “following a comprehensive investigation, WorkSafe has determined there is insufficient evidence to prosecute event organiser Ash Sounds Pty Ltd in relation to an incident at the company's Falls Music and Arts Festival in Lorne last year.”
It added “WorkSafe's investigation revealed that all the conditions imposed by various bodies in relation to the event, such as crowd control, crowd size, and positioning and size of exits, had been met.
“As a result, WorkSafe found there was insufficient evidence to establish any offence under the 2004 OHS Act and no further action will be taken.”
A class action against Falls Festival is still underway with lawyers representing the injured alleging negligence by organisers had led to the "avoidable" and "terrifying" accident.
